Self sustainability is a huge "topic" in today's economy. But I am a granddaughter of farmers and backyard farmers, it is just a lifestyle for myself and one I want to continue teaching my children. I know that I am not the only individual out there who has the same goals of fresh, healthy food and learning for the next generation. Unfortunately the City of Mary Esther does not allow for egg laying hens to be on homeowner's property within the city limits. This is the same city government that encourages (and I am fully behind) home gardening, city garden plot rentals and a garden society! All this to put fresh produce on tables in the community, a wonderful campaign! I am not a rebel, I do not like to rock the boat. I am a law abiding citizen who would like backyard chickens for my family! I know there are many residents who feel the same and here is the ordinance I would like approved by the City of Mary Esther:

Mary Esther, Florida – Chicken Ordinance

Sec. 4-5(6) (c) (d). ZONING CODE

j. Keeping of up to eight (8) chickens, provided that:
i. The principal use is a single-family dwelling.
ii. No person shall keep any rooster.
iii. No person shall slaughter any chickens.
iv. The chickens shall be provided with a covered enclosure and
must be kept in the covered enclosure or a fenced enclosure at all
times. (Sec. 4-12 (a) Shelter)
v. No enclosure shall be located closer than twenty-five (25) feet to
any residential structure on an adjacent lot.
vi. The owner or operator obtains a license under
Sec. 4-18 (a)(b) Per Household License Required

KEEPING OF CHICKENS.
Any person who keeps chickens in the City of Mary Esther shall obtain an annual license prior to January 1of each year, or within 30 days of acquiring the chickens. The license year commences on January 1 and ends on the following December 31.
Application shall be made to the City Treasurer and the fee for the license shall be ten dollars ($10.00). The Treasurer or other authorized individual shall collect the fee.

RELATING TO KEEPING OF CHICKENS WITHIN THE CITY OF MARY ESTHER.
(1) No person shall keep chickens within the City of Mary Esther in any unsanitary condition or within such proximity of dwelling houses or in any manner so as to be a nuisance.
(2) The Director of Public Health shall, upon complaint or on his own initiative, inspect, or order Health Inspectors to inspect, premises upon which chickens are kept and ascertain and determine whether the conditions are unsanitary or if for any reason a nuisance is caused thereby. If the Director of Public Health determines that conditions are unsanitary, or if for any reason a nuisance exists, he shall order the owner or occupant of the premises to abate the nuisance and it shall thereupon be unlawful to keep such chickens on the premises.
