For those of us who have Court Orders relating to Family Law know that, in reality, all we have done is line the solicitor's pockets. It did not benefit ourselves. Those Court Orders are not worth the paper they are written on. The Family Law Court in this country is a joke. People pay huge solicitor fees and go to court. Our judiciary system works out what they deem to be 'fair'. They send you on your merry way. End of story.
What happens to those of us who have gone through this process and the orders aren't being followed? The enforcement of Family Law matters falls into the hands of the Federal Police, yet if you call them they won't help. They advise another trip back to the Courthouse. Go back and waste the Court's time. All the while, the person whose not following the orders cops a slap on the wrist. Your stuck with a huge legal bill and a whole heap of anger, not to mention the fact that you haven't seen your child.
We need to acknowledge that there are Dad's (and Mum's) out there who ARE doing the right thing by their children. They pay child support and they take an interest in their children's lives. For some selfish reason an ex-partner is prohibiting the child from establishing or maintaining a healthy relationship with the other parent. Usually it's for their own spiteful reasons and to 'hurt' the person whose doing everything they can to be a loving parent.
What are the answers? Should State Police have authority in enforcing court orders? If a parent doesn't comply, should the police have the power to accompany you to collect that child? Should the punishments for breaking such orders be alot harsher?
I am lobbying Parliament for changes. How would he feel if someone just decided he couldn't see his child yet the law said he could? Maybe he should put himself in the position of thousands of parents in this country. I would like to hear from other people who are having issues with the enforcement of court orders.
